Common use of CLAIMS OR DEFENCES MAY NOT BE OPPOSED TO THE LENDERS Clause in Contracts

CLAIMS OR DEFENCES MAY NOT BE OPPOSED TO THE LENDERS. The Borrower may not escape liability under the terms of this Agreement by opposing to the Lenders claims or defences of any kind whatsoever arising under the Building Contract, and in particular from its performance, or from any other relationship between the Borrower and the Builder.
