Common use of Claims Under Indemnity Clause in Contracts

Claims Under Indemnity. In claims against Owner indemnified under this Agreement by an employee of Construction Manager, anyone directly or indirectly employed by Construction Manager or anyone for whose acts Construction Manager may be liable, the indemnification obligation under this Agreement shall not be limited by a limitation on amount or type of damages, compensation or benefits payable by or for Construction Manager under workers’ compensation acts, disability benefit acts or other employee benefit acts, nor shall the indemnification obligation be limited by the existence of any insurance policy.
