Common use of Class A Interests; Capital Contributions of the Class A Members Clause in Contracts

Class A Interests; Capital Contributions of the Class A Members. On each Initial Funding Date, Firstar shall make the Investor Initial Funding Contribution to be made by it with respect to the applicable Tranche pursuant to the terms and conditions set forth in the Equity Capital Contribution Agreement. In consideration of such Investor Initial Funding Contributions and the Investor True Up Funding Contributions to be made by the Investor pursuant to the Equity Capital Contribution Agreement, Firstar has been issued Class A Units in the amount set forth opposite its name in Exhibit A and has been admitted to the Company as a Class A Member. The Class A Members shall be entitled to the allocations, distributions and other rights as are prescribed for the Class A Members in this Agreement. Each Class A Member’s Capital Account balance as of the Effective Date and each Initial Funding Date thereafter with respect to its Membership Interest shall be as indicated on Exhibit A hereto.
