Class Action and other Filings. The Adviser acknowledges and agrees that (i) the Sub-Adviser is not responsible for filing proof of claim forms on behalf of Trust in any legal proceedings, including bankruptcies or class actions, involving securities held in or formerly held in the Portfolio or the issuers of those securities and (ii) the Sub-Adviser will not be required to advise or take any action on behalf of the Trust in any such legal proceedings
