Classification, Rules and Regulations. (a) The VESSEL shall be built in compliance with the rules and regulations of the American Bureau of Shipping (ABS), (hereinafter called the "CLASSIFICATION SOCIETY"), in force as of the date of this CONTRACT, to be classed and registered with the following class notation: and also to fully comply in all respects with the rules and regulations of the other Regulatory Bodies and authorities, in force as of the date of this CONTRACT, as described in the SPECIFICATIONS. (b) The BUILDER shall arrange with the CLASSIFICATION SOCIETY for the assignment by the CLASSIFICATION SOCIETY of representative(s) to the SHIPYARD for supervision of the construction of the VESSEL. All fees and charges incidental to classification of the VESSEL in compliance with the above specified rules, regulations and requirements of this CONTRACT, and compliance with all other specified rules, regulations and requirements of the SPECIFICATIONS shall be for the account of the BUILDER. (c) The decision of the CLASSIFICATION SOCIETY as to whether the VESSEL complies with the regulations of the CLASSIFICATION SOCIETY shall be final and binding upon the BUILDER and the BUYER. (d) The BUILDER undertakes to notify the CLASSIFICATION SOCIETY that the BUILDER agrees to the CLASSIFICATION SOCIETY releasing to the BUYER, upon the BUYER's request, such information as the BUYER may request and the BUILDER approves (such approval not to be unreasonably withheld), from the CLASSIFICATION SOCIETY regarding correspondence related to plan approval, rules, regulations, certification criteria issues, design assumptions relating to the classification and certification of the VESSEL.

Classification, Rules and Regulations. (ai) The VESSEL Vessel including its machinery, equipment and outfittings shall be built in compliance with the current rules and regulations of the American Bureau of Shipping (ABS), ) (hereinafter called the "CLASSIFICATION SOCIETY"“Classification Society”), in force as of the date of this CONTRACT, to be classed and registered as +A1 (E) “Oil / Chemical Carrier Ship type 3”, +AMS, +ACCU, +BWE, CSR, AB-CM, RES, VEC-L, CRC, ESP, UWILD, TCM, CPP and Xxxxxxxx Islands Flag and in accordance with the following class notation: standards provided in the Specifications. Vessel to be equipped in accordance with regulations of ABS and also to fully comply in all respects with the rules rules, regulations and regulations requirements of other regulatory bodies (including the aforementioned Flag) as described in the Specifications. All materials, machinery, equipment and accessories to be supplied for the construction of the other Regulatory Bodies Vessel shall be new, and authoritiesof qualified manufacture. The Vessel shall be constructed in sound, prudent and workmanlike manner and according to the Builder’s building practices, quality control.
(ii) References to rules, regulations and requirements in Paragraph (i) are to rules, regulations and requirements which are in force as at the date hereof and which are published and ratified as of the date of signing this CONTRACT, as described in Contract and to be effective on or before the SPECIFICATIONSdelivery of the Vessel.
(biii) The BUILDER Builder shall arrange with the CLASSIFICATION SOCIETY Classification Society for the assignment by the CLASSIFICATION SOCIETY Classification Society of representative(sa Representative or Representatives (hereinafter referred to as the “Classification Surveyor”) to the SHIPYARD for supervision of the construction of the VESSELVessel during construction. All fees and charges incidental to classification of the VESSEL Vessel in compliance with the above specified rules, regulations and requirements of this CONTRACT, and compliance with all other specified rules, regulations and requirements of the SPECIFICATIONS Contract shall be for the account of the BUILDERBuilder unless stipulated otherwise in the Specifications. All major plans, materials and workmanship used in the construction of the Vessel shall be subject to inspection and test by the Classification Society in accordance with the rules and regulations of the Classification Society.
(civ) The decision of the CLASSIFICATION SOCIETY Classification Society as to whether the VESSEL Vessel complies with the regulations of the CLASSIFICATION SOCIETY Classification Society shall be final and binding upon the BUILDER Builder and the BUYERBuyer. The facilities, labour and materials necessary for the safe and convenient conduct of any inspection by the Classification Society shall be furnished by the Builder without charge.
(d) The BUILDER undertakes to notify the CLASSIFICATION SOCIETY that the BUILDER agrees to the CLASSIFICATION SOCIETY releasing to the BUYER, upon the BUYER's request, such information as the BUYER may request and the BUILDER approves (such approval not to be unreasonably withheld), from the CLASSIFICATION SOCIETY regarding correspondence related to plan approval, rules, regulations, certification criteria issues, design assumptions relating to the classification and certification of the VESSEL.
