CLOSURE OR CONTRACTION. 5.10.1. If at any time during the Term of this Agreement, the Director, in his sole discretion, determines that it is necessary for the efficient operation of the Airport or to accommodate any construction, he may (i) require Concessionaire to close a Concession Facility or Facilities and/or (ii) require Concessionaire to reduce the square footage of a Concession Facility or Facilities. This shall be a continuing right of the Director throughout the Term. If the Director requires Concessionaire to close a Concession Facility or Facilities, Concessionaire shall vacate the Concession Facility or Facilities within 90 days after receipt of a closure notice from the Director unless circumstances require an earlier closure.
