Co-Trustees; Separate Trustee; Collateral Agent Clause Samples
The "Co-Trustees; Separate Trustee; Collateral Agent" clause defines the roles and authority of additional trustees or agents appointed alongside the primary trustee in a trust or financing arrangement. It typically outlines the circumstances under which a co-trustee or separate trustee may be appointed, such as to comply with legal requirements in different jurisdictions or to facilitate the administration of trust assets, and clarifies the powers and responsibilities of a collateral agent who may hold security interests on behalf of beneficiaries or creditors. This clause ensures that the trust or security arrangement can be effectively managed across various legal environments and that the interests of all parties are protected, thereby addressing potential administrative or legal obstacles that could arise if only a single trustee or agent were involved.
