Cogenerator Reviews. Various design details, submittals and project interfaces will need to be reviewed by the Cogenerator or will be requested by the City to be reviewed by the Cogenerator. All NCEP interfaces or points of connections, including routing of roads, switchgear, transformers, piping, conduits and their supports and trenches on the NCCF site or on the NCWRP site, that materially affect the Cogenerator owned utilities, will be submitted to the Cogenerator for approval. Any submittal with information or designs that require the Cogenerator’s approval will be identified by the City as they are submitted. Electronic submittals in a format that both parties can read will be acceptable. The Cogenerator shall provide its written responses to City submittals within three weeks of their receipt. On submittals that do not need the Cogenerator’s approval, the Cogenerator will use good faith efforts to give the City a response within one week of receiving the information on whether it chooses to review the submittal, and will provide a date at such time for when the review, if any, will be received by the City. On items that require the Cogenerator’s approval, the City may assume the Cogenerator’s approval has been granted if no notice of disapproval nor the Cogenerator’s comments have been provided within four weeks after the Cogenerator’s receipt of the City’s submittal. The City and Cogenerator shall resolve Cogenerator’s comments or approval issues within two weeks after the City’s receipt of Cogenerator’s comments or denial of approval.
