COLLECTION COSTS AND ATTORNEY FEES. Lessee agrees to pay Lessor as additional rent all costs of collection and all attorney fees incurred by Lessor in enforcing the terms of this lease, including all such costs and fees incurred in any action for rent and possession of the premises. As consideration of this Lease, the Lessee further agrees to pay all attorney fees for Lessor in defending any suit brought by Lessee in the event a lawsuit is filed by Lessee for a refund of the deposit and Lessee does not recover substantially all of the sums prayed for in the lawsuit. LESSEE HEREBY AGREES TO WAIVE A JURY TRIAL IN SUCH CASE, AS PART OF THE CONSIDERATION OF THE SIGNING OF THIS LEASE. The undersigned understands and agrees that a collection fee of up to 40% of any defaulted balance will be added to the total amount due to the lessor should this account enter default and have to be placed with a third party collections firm for resolution.
