Common use of Collection Suit by Trustee or Collateral Agent Clause in Contracts

Collection Suit by Trustee or Collateral Agent. If an Event of Default specified in Sections 6.01(1) or (2) hereof occurs and is continuing, the Trustee or the Collateral Agent may recover judgment (a) in its own name and (b)(1) in the case of the Trustee, as trustee of an express trust or (2) in the case of the Collateral Agent, as noteholder Collateral Agent on behalf of the Holders, in each case against the Company for the whole amount of principal of, premium, if any, and interest remaining unpaid on, the Notes and interest on overdue principal and, to the extent lawful, interest and such further amount as shall be sufficient to cover the costs and expenses of collection, including the reasonable compensation, expenses, disbursements and advances of the Trustees, the Collateral Agent and their respective agents and counsel.

If an Event of Default specified in Sections 6.01(1Section 6.1(a) or (2b) hereof occurs and is continuing, the Trustee or and/or the Collateral Agent may recover judgment (a) in its own name and (b)(1) in the case of the Trustee, as trustee of an express trust or (2) in the case of the Collateral Agent, as noteholder Collateral Agent on behalf of the Holders, in each case against the Company or any other obligor on the Securities for the whole amount of principal ofprincipal, premium, if any, and accrued interest remaining unpaid onunpaid, the Notes and together with interest overdue on overdue principal principal, premium, if any, and, to the extent that payment of such interest is lawful, interest on overdue installments of interest, in each case at the Interest Rate and in such further amount as shall be sufficient to cover the costs and expenses of collection, including the reasonable compensation, expenses, disbursements and advances of the Trustees, Trustee and/or the Collateral Agent and Agent, their respective agents and counsel.
