Common use of COMBINATION ARBITRATION/LITIGATION Clause in Contracts

COMBINATION ARBITRATION/LITIGATION. SHIPPER BROKER Subject to the time limitations set forth in Par. 7 above, for disputes where the amount in controversy exceeds $ the Parties shall have the right, but not the obligation, to select litigation in order to resolve any disputes arising hereunder. In the event of litigation the prevailing Party shall be entitled to recover costs, expenses and reasonable attorney fees, including but not limited to any incurred on appeals.
