Common use of Combination Settlement Clause in Contracts

Combination Settlement. If the Issuer elects (or is deemed to have elected) Combination Settlement, the Issuer shall pay or cause to be delivered, as the case may be, to the exchanging Holder in respect of each $1,000 principal amount of the Notes being exchanged, a settlement amount equal to the sum of the Daily Settlement Amounts for each of the thirty (30) consecutive VWAP Trading Days during the applicable Observation Period; provided, however, that the Issuer shall pay an amount of cash in lieu of any fractional Ordinary Shares determined in accordance with Section 7.03(a)(iv) hereof. The Issuer shall pay or cause to be delivered, as the case may be, such settlement amount on the third Business Day immediately following the last VWAP Trading Day of such Observation Period.

Combination Settlement. The Issuer shall pay or cause to be delivered, as the case may be, such settlement amount on the third second Business Day immediately following the last VWAP Trading Day of such Observation Period.
