Commencement of Project. If a project is not operational within 60 days after the date of full execution of this Agreement, Subrecipient must report by letter to the City, the steps taken to initiate the project, the reasons for delay, and the expected start date. 6.3.1 If a project is not operational within 90 days after the date of full execution of this Agreement, the Subrecipient must submit a second statement to the City explaining the implementation delay. 6.3.2 Upon receipt of the ninety (90) day letter, the City will determine if the reason for the delay is justified or will, at the City’s discretion, unilaterally terminate this agreement. The City, where warranted by extenuating circumstances may extend the starting date of the project past the ninety (90) day period, but only by formal written amendment to this agreement.
