Common use of Commissioner’s Decision Clause in Contracts

Commissioner’s Decision. The Commissioner’s final decision shall be rendered in writing no more than thirty-five (35) days after receipt of the response of the Owner was filed or was due unless the Commissioner notifies the Manager before the end of the thirty-five (35) day period that an additional period, not to exceed thirty (30) days, is needed for the Commissioner to respond. The Commissioner’s decision shall be conclusive, final, and binding on all parties unless a judicial determination is sought in accordance with the provisions set forth below.
