Commitment Amount; No Increase. The amount of the Commitment is $156,359,000. As of the Initial Closing Date, the amount advanced under the Fixed Facility Commitment is $156,359,000, and the amount advanced under the Variable Facility Commitment is $0. Subject to the terms and conditions of this Agreement, including without limitation Section 1.10, Borrower may obtain Future Advances in accordance with Section 1.01(b) and (c) for the remainder of the Commitment not advanced on the Initial Closing Date. Subject to the provisions of Section 2.05, notwithstanding anything to the contrary contained in this Agreement, Borrower shall have no right to increase the amount of the Commitment (except for an increase in the Fixed Commitment pursuant to a conversion under Section 1.06 of this Agreement).
