Commonwealth exception. If a Party is a Department or Agency of the Commonwealth Government of Australia, it is excluded from the obligation under clause 27.1 to indemnify any other Party. This clause 27.4 does not exclude or reduce the liability of, or benefit to, the Commonwealth that may arise by operation of the common law or breach of statute.
Commonwealth exception. (a) If the Commonwealth is a Party, it is excluded from the obligation under clause 21.1 to indemnify the other Parties. (b) This clause 21.3 does not exclude or reduce the liability of, or benefit to, the Commonwealth that arises by operation of law or breach of statute.
