Communication by Counse l. Class Counsel, Defendant, and Defendant’s Counse l agree that they shall not solicit Putative Class Members or Opt-In Plaintiffs to exclude themselve s from or participate in this settlement. Class Counsel further agree that they shall not initiate contact with the Putative Class Members during the settlement approval process. Nothing shall prevent Counsel for Settlement Plaintiffs from responding to inquiries from Putative Class Members and Opt-In Plaintiffs. For its part, Defendant agrees that it shall not discourage Putative Class Members from participating in the settlement and shall refer any questions to the Settlement Administrator.
