Common use of Communications and Exchange of Information Clause in Contracts

Communications and Exchange of Information. All invoices, bids or applications to purchase Capacity, offers for Buy-back, Nominations, Allocations and other communications which are required to be given or made by the IAA Shipper to IUK or by IUK to the IAA Shipper in accordance with this Agreement shall be given or made electronically on the IUK Information System unless permitted to be made on the Joint Booking Platform under Section B of the IUK Access Code or such other method as specified by IUK. Where the IUK Information System is not available, all invoices, bids or applications to purchase Capacity, offers for Buy-back, Nominations, Allocations and other communications shall for the duration of such event be given or made by such alternative means as are specified by IUK. The IAA Shipper shall enter into a System User Agreement prior to being granted access to the IUK Information System. All invoices, bids or applications to purchase Capacity, offers for Buy-back, Nominations, Allocations and other communications are: (a) given or made where they are entered on or electronically transmitted to the IUK Information System and may be accessed on the IUK Information System; and (b) are deemed to have been received by the relevant recipient(s) at the time when they are given or made.

All invoices, bids or applications to purchase Capacity, offers for Buy-back, Nominations, Allocations and other communications are: (a) given or made where they are entered on or electronically transmitted to the IUK Interconnector Information System and may be accessed on the IUK Interconnector Information System; and (b) are deemed to have been received by the relevant recipient(s) at the time when they are given or made.
