Common use of Company Liable for Servicer and Subservicers Clause in Contracts

Company Liable for Servicer and Subservicers. Notwithstanding anything to the contrary contained herein, the use of the Servicer (or any Subservicer) shall not release the Company from any of its Servicing Obligations or other obligations under this Agreement, and the Company shall remain responsible and liable for all acts and omissions of the Servicer (and each Subservicer of the Servicer) as fully as if such acts and omissions were those of the Company. All actions of the Servicer (or any Subservicer) performed pursuant to the Servicing Agreement (or a Subservicing Agreement) shall be performed as an agent of the Company (or, in the case of Subservicers, the Servicer).
