The 'Company Personal Data' clause defines the types of personal information that belong to the company and sets out how such data should be handled within the context of the agreement. Company Personal Data. Notwithstanding anything to the contrary in this DPA or the Agreement, TD shall have no indemnification obligations to Company to the extent of any Liability arising from Company’s breach of Section 2.9 (Company Personal Data Provided to TD). Company shall be required to indemnify TD for any Liabilities arising from any such breach and such indemnification obligations shall not be subject to the limitation of liability set forth in Section 9.1.
Company Personal Data. In the event that Supplier accesses or otherwise Processes any Company Personal Data during its performance of the Agreement, it shall comply with the following obligations regarding Company Personal Data: (i) Supplier shall view and Process Company Personal Data only to the extent necessary to perform this Agreement or upon Company’s written instructions; (ii) Supplier undertakes to keep Company Personal Data confidential, and agrees to not disclose Company Personal Data to third parties without having first received express written approval from Company; and
Company Personal Data. During the Term, Company may provide to NetAlly Company Data. NetAlly may use Company Data in connection with the performance of its obligations under these General T&Cs. Company hereby agrees to strictly comply with any and all applicable Data Protection Acts with regards to the transfer, handling storage and processing of Personal Data. Company acknowledges and agrees that should Company transfer such Personal Data to NetAlly, or other third-parties, Company will serve as such Personal Data’s “Controller”, as set forth in the applicable Data Protection Acts. Further, in the event of a breach of Personal Data, attributed to Company’s actions or inactions in furtherance of these General T&Cs, in violation of the Data Protection Acts, Company shall promptly (i) take all necessary steps to curtail such breach; (ii) undertake all necessary actions to mitigate damages; (iii) provide the necessary notification and remediation, as set forth in the applicable Data Protection Act; and (iv) aid and assist in NetAlly’s efforts to do the same, at Company’s sole cost and expense.

Company Personal Data. 9.1 Subject to sections 9.2 and 9.3 We shall promptly and in any event within 60 days of the date of cessation of any Services involving the Processing of Company Personal Data (the "Cessation Date"), delete and procure the deletion of all copies of Company Personal Data.
9.2 We and each Subprocessor may retain Company Personal Data to the extent required by Applicable Laws and only to the extent and for such period as required by Applicable Laws. We and each Subprocessor shall ensure the confidentiality of all Company Personal Data and shall ensure that Company Personal Data is only Processed as necessary for the purpose(s) specified in the Applicable Laws requiring its storage and for no other purpose.
9.3 If requested by You, We shall provide written certification to You that We have fully complied with this section 9.
Company Personal Data. When the Company uses the PayPal Tracking Autopilot, the Data Processor collects Company Personal Data the Company provides about Shopify Store orders. No Customer Personal Data is stored. o Order Data – When the Company’s customers place orders in Company’s Shopify Store, the Data Processor collects Company Personal Data such as order date, order id, order items id, payment gateway, PayPal transaction number according to Shopify API (access granted with installation) necessary to provide and fulfil Services. By using time machine function also historical orders will be processed. No Personal Data of Company’s customers is stored. o Fulfillment creation and update – When the Company enters or changes the fulfillment information of a customer order in Company’s Shopify Store, the Data Processor collects Company Personal Data such as fulfillment date and time, shipping company and tracking id as well as shipping status according to Shopify API (access granted with installation) as necessary to provide and fulfil Services. o PayPal synchronization – The PayPal synchronization service collects Company Personal Data such as successfully synchronized tracking data as well as errors during synchronizations. o PayPal API credentials – When the Company uses the PayPal Tracking Autopilot, the Company must provide write access credentials for fulfillment data at the Company’s Payment Provider PayPal account. App Charge Data – When the Company uses the PayPal Tracking Autopilot, application usage charges as well as recurring charges may apply according to the selected subscription plan. The Data Processor, therefore, collects usage data such as charge rate, and charge date as well as subscription data such as subscription change date, and subscription model. Furthermore, the Data Processor provides these data to the Company’s Shopify Store for billing and invoicing according to Shopify’s billing API. Other information collected related to Company’s use of Sites or Services of Data Processor – The Data Processor may collect additional information from or about the Company when the Company communicates with the Data Processor, contact customer support teams, or respond to a survey.
