Compensation and Damages for Violation. For each separate instance of unauthorized Media Activity in violation of this Paragraph 15, each affected ARTIST shall be compensated at the rate established by the union (if any) having jurisdiction over the type of Media Activity involved, or, if no such rate has been established, at the appropriate performance rate set forth in this Agreement.
