Common use of Compensation During Disability Clause in Contracts

Compensation During Disability. In the event of the Executive’s failure to satisfactorily perform his duties hereunder on a full-time basis by reason of his incapacity due to physical or mental illness for any period not otherwise constituting Disability as defined under sub-paragraph (vi) of Paragraph 7(a) hereof, the Executive’s employment hereunder shall not be deemed terminated and he shall continue to receive the compensation and benefits provided under Paragraph 5 in accordance with the terms thereof.

Compensation During Disability. In the event even of the Executive’s 's failure to satisfactorily perform his her duties hereunder on a full-time basis by reason of his her incapacity due to physical or mental illness (as determined by the Executive's regular attending physician) for any period not otherwise constituting Disability as defined under sub-paragraph (vi) of Paragraph 7(aparagraph (a) hereofof this Section 6, the Executive’s 's employment hereunder shall not be deemed terminated and he she shall continue to receive the compensation and benefits provided under Paragraph Section 5 in accordance with the terms thereof.
