Common use of Compensation for Damages or Losses Clause in Contracts

Compensation for Damages or Losses. When investments by investors of either Contracting Party suffer damages or losses owing to war, armed conflict, a state of national emergency, revolt, insurrection, riot or other similar events in the territory of the other Contracting Party, they shall be accorded by the latter Contracting Party a treatment, as regards compensation or other settlement, not less favourable than that accorded to its own investors or to investors of any Third State.

Compensation for Damages or Losses. When investments by If investors of either Contracting Party suffer damages loss or losses owing damage to war, armed conflict, a state of national emergency, revolt, insurrection, riot or other similar events their investments in the territory of the other Contracting PartyParty owing to war or other armed conflict or civil strife, state of emergency or other similar events, the Contracting party that received investment, shall grant adequate compensation for losses or damages, regardless of whether they have been caused by government forces or by other subjects. The compensation shall be accorded by paid in a freely convertible currency and freely transferable without undue delay. The Investor affected shall be entitled to the latter same treatment to nationals of the other Contracting Party a treatmentand, as regards compensation or other settlementin any event, not no less favourable treatment than that accorded to its own investors or to investors of any Third Statethird States.

Such payments shall be freely transferable.

When Investors of one of the Contracting Parties who incur losses or damages in their investments by investors of either Contracting Party suffer damages or losses owing to war, armed conflict, a state of national emergency, revolt, insurrection, riot or other similar events in the territory of the other Contracting PartyParty due to war or other forms of armed conflict, they shall be accorded by revolutions, national emergency, rebellion, insurrection or rebellion in the latter territory of The Contracting Party a treatmentconcerned shall receive, as regards with regard to the refund, compensation or other settlementform of compensation, not no less favourable favorable treatment than that accorded to its own investors or to investors of any Third Statethird countries.

When investments In the case of losses of investment by the investors of either one of the Contracting Party suffer damages or losses owing to war, armed conflict, a state of national emergency, revolt, insurrection, riot or other similar events Parties in the territory of the other Contracting PartyParty as a result of war, they other armed conflicts, national emergency or civil unrest, investors of that other Contracting Party shall be accorded by the latter Contracting Party a treatment, as regards compensation or other settlement, not treatment no less favourable favorable than that accorded to its own investors or to investors of a third State in respect of compensation and restitution to its owners and any Third Stateform of settlement, and enjoy any payments made under this Article.
