Common use of Compensation to Settlement Class Members and Plan of Allocation Clause in Contracts

Compensation to Settlement Class Members and Plan of Allocation. Subject to the terms of this Settlement Agreement, Wawa shall provide the following compensation to Settlement Class Members who submit a valid Claim Form as properly determined by the process described herein. Each Class Member is entitled to compensation in one Tier only and will be required to select a Tier when a claim is submitted. If a Class Member submits multiple Claim Forms for more than one Tier, the higher tier Claim Form will determine the amount of benefit the Class Member receives. Each Class Member will be entitled to one payment in their respective Tier, regardless of the number of payment cards they used at Wawa during the Period of the Data Security Incident, and regardless of the number of transactions that occurred within that time period.
