COMPENSATION TO TENANT FOR TEMPORARY USE. If the temporary use or occupancy of all or any part of the Premises shall be taken by condemnation or in any other manner for any public or quasi-public use or purpose during the Term, Tenant shall be entitled, except as hereinafter set forth, to receive that portion of the award or payment for such taking which represents compensation for the use and occupancy of the Premises, for the taking of Tenant's Property and for moving expenses, and Landlord shall be entitled to receive that portion that represents reimbursement for the cost of restoration of the Premises. This Lease shall be and remain unaffected by such taking, and Tenant shall continue to be responsible for all of its obligations hereunder insofar as such obligations are not affected by such taking and shall continue to pay, in full, the Base Rent and Additional Rent when due. If the period of temporary use or occupancy shall extend beyond the Expiration Date, that part of the award that represents compensation for the use and occupancy of the Premises (or a part thereof) shall be prorated between Landlord and Tenant so that Tenant shall receive so much thereof as represents the period up to and including such Expiration Date and Landlord shall receive so much thereof as represents the period after such Expiration Date. All monies paid as, or as part of, an award for temporary use and occupancy for a period beyond the date to which the Base Rent and Additional Rent have been paid shall be received, held and applied by Landlord as a trust fund for payment of the Base Rent and Additional Rent becoming due.

All monies paid asNotwithstanding anything contained herein to the contrary, Tenant may terminate this Lease upon ten (10) days prior written notice to Landlord in the event of a temporary taking or as part of, an award for temporary condemnation that materially and adversely affect Tenant's use and occupancy of the Premises pursuant to this Section 18.3 which Tenant reasonably believes will last for a period beyond of at least one (1) year from the date to which the Base Rent and Additional Rent have been paid shall be receivedof such taking or condemnation, held and applied by Landlord as a trust fund for payment of the Base Rent and Additional Rent becoming dueapplicable.

Notwithstanding the foregoing provisions of this Section 19.3 to the contrary, if the temporary use is in excess of 90 days, then Tenant will within 30 days thereafter have the option to terminate this Lease upon at least 30 days' advance written notice to Landlord.

This Lease shall be and remain unaffected by such taking, and Tenant shall continue to be responsible for all of its obligations hereunder insofar as such obligations are not affected by such taking and shall continue to pay, in full, the Base Rent and Additional Rent when due. If the period of temporary use or occupancy shall extend beyond the Expiration Date, that part of the award that represents compensation for the use and occupancy of the Premises (or a part thereof) shall be prorated between Landlord and Tenant so that Tenant shall receive so much thereof as represents the period up to and including such Expiration Date and Landlord shall receive so much thereof as represents the period after such Expiration Date. All monies paid as, or as part of, an award for temporary use and occupancy for a period beyond the date to which the Base Rent and Additional Rent have been paid shall be received, held and applied by Landlord as a trust fund for payment of the Base Rent and Additional Rent becoming due.

This Lease shall be and remain unaffected by such taking, taking and Tenant shall continue to be responsible for all of its obligations hereunder insofar as such obligations are not affected by such taking and shall continue to pay, pay in full, full the Base Gross Rent and Additional Rent when due. If the period of temporary use or occupancy shall extend beyond the Expiration Dateexpiration date of this Lease, that part of the award that which represents compensation for the use and occupancy of the Premises (or a part thereof) shall be prorated divided between Landlord and Tenant so that Tenant shall receive so much thereof as represents the period up to and including such Expiration Date expiration date and Landlord shall receive so much thereof as represents the period after such Expiration Dateexpiration date. All monies paid as, or as part of, an award for temporary use and occupancy for a period beyond the date to which the Base Gross Rent and Additional Rent have been paid shall be received, held and applied by Landlord as a trust fund for payment of the Base Gross Rent and Additional Rent becoming duedue hereunder.
