Completion Date - Delays. Subject to delay by causes beyond the reasonable control of Landlord or caused by the action or inaction of Tenant, Landlord shall use reasonable diligence in order to have the Demised Premises ready for occupancy by Tenant on July1, 2011. The failure to have the Demised Premises so ready by a particular date shall in no way affect the validity of this Lease or the obligations of Tenant hereunder, provided however that Tenant shall be entitled to a credit, to be applied on account of installments of Yearly Fixed Rent first becoming due hereunder, equal to $909.33 for each day after June 30, 2011 on which the Term Commencement Date has not occurred.

The failure to have the Demised Premises so ready by a particular date shall in no way affect the validity of this Lease or the obligations of Tenant hereunder, provided however that Tenant may terminate this Lease by notice given to Landlord at any time after May 31, 2001 if the Demised Premises are not ready for Tenant’s occupancy within fifteen (15) days following receipt of such notice.
