Common use of Compliance; Hazardous Materials Clause in Contracts

Compliance; Hazardous Materials. Shall strictly comply with all laws, regulations, ordinances and other legal requirements, specifically including, without limitation, ERISA, all securities laws and all laws relating to hazardous materials and the environment. Unless approved in writing by Bank, neither Borrower nor any Subsidiary shall engage in the storage, manufacture, disposition, processing, handling, use or transportation of any hazardous or toxic materials, whether or not in compliance with applicable laws and regulations.

Unless approved in writing by BankAgent, neither Borrower nor any Subsidiary shall engage in the storage, manufacture, disposition, processing, handling, use or transportation of any hazardous or toxic materials, whether or not in compliance with applicable laws and regulationsregulations except for ordinary and customary amounts of solvents, cleaners and similar materials used in the ordinary course of Borrower’s business in strict compliance in all material respects with all Environmental Laws.
