Common use of Compliance with 1940 Act Clause in Contracts

Compliance with 1940 Act. Any contract entered into pursuant to Sections 3.1 or 3.2 shall be consistent with and subject to the requirements of Section 15 of the 1940 Act (including any amendment thereof or other applicable Act of Congress hereafter enacted), as modified by any applicable order or orders of the Commission, with respect to its continuance in effect, its termination and the method of authorization and approval of such contract or renewal thereof.

Any contract entered into pursuant to Sections 3.1 4.1 or 3.2 4.2 and which governs the provision of services as described in Section 15 of the 1940 Act shall be consistent with and subject to the requirements of Section 15 of the 1940 Act (including any amendment thereof or other applicable Act of Congress hereafter enacted), as modified by any applicable order or orders of the Commission, ) with respect to its continuance in effect, its termination and the method of authorization and approval of such contract or renewal thereof.
