Common use of Compliance with Applicable Requirements Clause in Contracts

Compliance with Applicable Requirements. In carrying out its obligations under this Agreement, the Adviser shall at all times conform to: 1. all applicable provisions of the 1940 Act; 2. the provisions of the current Registration Statement of the Fund; 3. the provisions of the Fund's Articles of Incorporation, as amended; 4. the provisions of the Bylaws of the Fund, as amended; and 5. any other applicable provisions of state and federal law.

Compliance with Applicable Requirements. In carrying out its obligations under this Agreement, the Adviser shall at all times conform to: 1. all applicable provisions of the 1940 Act; 2. the provisions of the current Registration Statement of the Fund; 3. the provisions of the Fund's Articles Declaration of IncorporationTrust, as amended; 4. the provisions of the Bylaws of the Fund, as amended; and 5. any other applicable provisions of state and federal law.

In carrying out its obligations under this Agreement, the Adviser shall at all times conform to: 1. all applicable provisions of the 1940 Act; 2. the provisions of the current Registration Statement of the FundCompany; 3. the provisions of the Fund's Articles of Incorporation, as amended; 4. the provisions of the Bylaws of the Fund, as amended; and 5. any other applicable provisions of state and or federal law.

(a) all applicable provisions of the 1940 ActAct and any rules and regulations adopted thereunder; 2. (b) the provisions of the current Registration Statement of the FundFund under the 1933 Act and the 1940 Act; 3. (c) the provisions of the Fund's Articles of Incorporation, as amended; 4. (d) the provisions of the Bylaws of the Fund, as amendedBy-Laws; and 5. (e) any other applicable provisions of state and federal law.

(a) all applicable provisions of the 1940 ActAct and any rules and regulations adopted thereunder; 2. (b) the provisions of the current Registration Statement of the FundFund under the 1933 Act and the 1940 Act; 3. (c) the provisions of the Fund's Articles of Incorporation, as amended; 4. (d) the provisions of the Bylaws of the Fund, as amendedBy-laws; and 5. (e) any other applicable provisions of state Federal and federal State law.

In carrying out its obligations under this Agreement, the Adviser shall at all times conform to: 1. all applicable provisions of the 1940 Act; 2. the provisions of the current Registration Statement registration statement of the Fund, as the same may be amended from time to time, under the 1933 Act and the 1940 Act; 3. the provisions of the Fund's Articles of Incorporation, as amended; 4. the provisions of the Bylaws of the Fund, as amended; and 5. any other applicable provisions of state and federal law.

Fund under the provisions Securities Act of 1933 and the Fund's Articles Investment Company Act of Incorporation, as amended; 4. the provisions of the Bylaws of the Fund1940, as amended; and 5. (c) the provisions of the Articles of Incorporation of the Fund; and (d) the provisions of the By-Laws of the Fund; and (e) any other applicable provisions of state and federal law.

") and any rules and regulations adopted thereunder as amended; and (b) the provisions of the current Registration Statement of the Fund; 3. Fund under the Securities Act of 1933 and the Investment Company Act of 1940, as amended; and (c) the provisions of the Fund's Articles of Incorporation, as amended; 4. Incorporation of the Fund; and (d) the provisions of the Bylaws By-Laws of the Fund, as amended; and 5. and (e) any other applicable provisions of state and federal law.
