Compliance with Applicable. REQUIREMENTS In carrying out its obligations under this Agreement, the Adviser shall at all times conform to: 1. all applicable provisions of the 1940 Act; 2. the provisions of the current Registration Statement of the Fund; 3. the provisions of the Fund's Declaration of Trust, as amended; 4. the provisions of the Bylaws of the Fund, as amended; and 5. any other applicable provisions of state and federal law.
