Compliance with Eligibility Criteria. The generation technology deployed by the Facility is the Facility Generation Technology. A Generator shall not be deemed to be in breach of this Condition 28.2(B) by virtue of a failure to comply with any requirement in the EA 2013 Regulations relating to minimum cable lengths, provided that such failure occurs solely as a result of the Main Interconnected Transmission System having been extended after the relevant Application Closing Date.
