Compliance with Final Environmental Impact Statement & Supplemental Environmental Impact Statement. Borrower has furnished to Lender evidence satisfactory to Lender that the Project is in compliance with the “September 2010 Final Environmental Impact Statement for the Villages of Aina Le`a” and that the portions of the Supplemental Environmental Impact Statement for the Village of Aina Le`a currently in process with the Planning Department of the County of Hawaii which are applicable to the Project do not limit or restrict the construction of the Improvements by Borrower and to the extent necessary will be completed prior to any request by Borrower for issuance of a certificate of occupancy by the County of Hawaii for any of the forty (40) townhome units in the Project.
