Common use of Compliance with Permits and Applicable Laws Clause in Contracts

Compliance with Permits and Applicable Laws. 5.1 Contractor shall operate and maintain the Facility and Refuse Area(s) and shall perform the Services in accordance with all federal, state and local laws, rules and regulations, now or hereafter in effect, and the Permits (and any additional permits obtained in the future) to operate the Facility and Refuse Area(s). Unless otherwise agreed, Operator shall obtain and maintain in full force and effect, at its sole expense, all permits and approvals necessary for Contractor to operate the Facility and Refuse Area(s) under this Agreement. Notwithstanding the foregoing, Contractor agrees to provide such permitting assistance to Operator as Operator may reasonably request. Contractor shall secure an MSHA Identification Number prior to entering the Premises and/or Facility to perform the Services. Contractor shall file all necessary reports or other documents, whether mandatory or permissible, with the applicable governmental or other officer in order to properly establish and serve notice of Contractor’s sole and exclusive responsibility for the health and safety of its employees, agents and permitted subcontractors and responsibility for compliance with such laws, rules and regulations during the term of this Agreement. 5.2 Contractor shall at all times comply with all applicable federal, state and local laws (including, but not limited to, the Federal Mine Safety and Health Act of 1977, as amended), ordinances, rules, regulations, codes and orders relating to the Services and/or applicable to the Facility and the Premises and with the safety policies, rules and regulations of Operator. 5.3 Contractor shall implement a drug testing policy applicable to all of Contractor’s employees, agents, and subcontractors performing work or activities under this Agreement or who enter upon the Facility and/or the Premises in connection with this Agreement, which policy shall comply with all state, federal and local laws, ordinances, rules and regulations and shall be satisfactory to Operator.

Contractor shall file all necessary reports or other documents, whether mandatory or permissible, with the applicable governmental or other officer office(s) in order to properly establish and serve notice of Contractor’s sole and exclusive responsibility for the health and safety of its employees, agents and permitted subcontractors and responsibility for compliance with such laws, rules laws and regulations during the term of this Agreement. 5.2 Contractor shall at all times comply with all applicable federal, state and local laws (including, but not limited to, the Federal Mine Safety and Health Act of 19771997, as amended), ordinancesamended),ordinances, rules, regulations, codes and orders relating to the Services and/or applicable operations and services to the Facility be conducted and the Premises performed hereunder and with the safety policies, rules and regulations of OperatorOwner. 5.3 Contractor shall implement a drug testing policy applicable to all of Contractor’s employees, agents, agents and subcontractors performing work or activities under this Agreement or who enter upon the Facility and/or the Premises in connection with this Agreement, which policy shall comply with all state, federal and local laws, ordinances, rules ordinances and regulations and shall be satisfactory to OperatorOwner.
