Common use of Compliance with Program Requirements Clause in Contracts

Compliance with Program Requirements. The Borrower agrees that at all times its actions regarding the Development and the use of funds provided under the Standard Agreement shall be in conformity with all Program Requirements, including the requirements of this Agreement and the other Loan Documents. The Borrower acknowledges that it is familiar with the Program Requirements and has access to professional advice to the extent necessary to enable the Borrower to fully comply with the Program Requirements.

Compliance with Program Requirements. The Borrower agrees that at all times its actions regarding the Development and the use of funds provided under the Standard Development Agreement shall be in conformity with all requirements of the Program Requirements, including the requirements of the Loan Documents, this Agreement Agreement, the above-referenced statutes and the other Loan Documentspolicies and procedures of the Department pertaining thereto. The Borrower acknowledges that it is familiar with the above-referenced Program Requirements requirements and has access to professional advice to the extent necessary to enable the Borrower to fully comply with the Program Requirementsrequirements. Borrower specifically covenants to perform its obligations under the Standard Agreement, the Development Agreement and the Note.
