COMPLIANCE WITH RFP. Competitive Supplier (i) represents and warrants that all representations and statements of fact made as part of its RFP bid response are true and accurate as of the Effective Date; (ii) covenants that it shall perform all obligations of Competitive Supplier made as part of its RFP bid response; and (iii) to its knowledge, as of the Effective Date, is compliant with the terms and conditions set forth in the RFP.
