Common use of Compliance with Third Party Payor Program Requirements Clause in Contracts

Compliance with Third Party Payor Program Requirements. Tenant shall, at its sole cost and expense, make whatever improvements (capital or ordinary) as are required to conform the Leased Property in all material respects to such standards, if any, as may, from time to time, be required by any applicable Third Party Payor Programs to the extent Tenant is a participant in such Third Party Payor Programs (it being acknowledged that participation in such Third Party Payor Programs is at the sole and absolute discretion of Tenant), or any other applicable programs or legislation, or capital improvements required by any other governmental agency having jurisdiction over the Leased Property as a condition of the continued operation of the Leased Property for its Intended Use, except where the failure to comply will not have a material adverse effect on the use or operation of the Leased Property for its Intended Use.
