Common use of Compliance with Warranties, No Default, etc Clause in Contracts

Compliance with Warranties, No Default, etc. Both before and after giving effect to any Borrowing, the following statements shall be true and correct (a) the representations and warranties set forth in Article VI (other than the representations contained in Sections 6.6 and 6.7) shall be true and correct with the same effect as if then made (unless stated to relate solely to an earlier date, in which case such representations and warranties shall be true and correct as of such earlier date); and (b) no Default or Event of Default shall have then occurred and be continuing.

Compliance with Warranties, No Default, etc. Both before and after giving effect to any Borrowing, such Borrowing the following statements shall be true and correct correct: (a) the representations and warranties set forth in Article VI (other than the representations excluding, however, those contained in Sections 6.6 6.10 and 6.76.13) shall be true and correct with the same effect as if then made (unless stated to relate solely to an earlier date, in which case such representations and warranties shall be true and correct as of such earlier date)made; and and (b) no Default and no Prepayment Event and no event which (with notice or lapse of time or both) would become a Prepayment Event of Default shall have then occurred and be continuing.
