Concession Equipment. The District shall provide the Equipment set forth in Exhibit “A” to this Agreement for Concessionaire’s use in operation of the Concession Stand for the purposes set forth herein (“Concession Equipment”). Concessionaire shall not make any alterations, additions, or improvements to the Concession Stand or Concession Equipment without the District’s prior written consent. In the event the District consents to the making of any alterations, additions or improvements to the Concession Stand or Concession Equipment, the same shall be made at Concessionaire’s sole cost and expense, and in the event such alterations, additions or improvements are made to a structure, building or other improvement attached to the real property, the same will become a part of the real property and be surrendered to the District upon the termination if this Agreement.
Concession Equipment. The concessionaire shall furnish, at its own cost and expense, all necessary concession equipment, furniture, signs, fixtures and uniforms.
Concession Equipment. The Authority and Team each acknowledge that the design and procurement of certain food service equipment, fixtures, furnishings, technology and smallwares within the Project (collectively, the "Concession Equipment") will not occur until after Certification of GMP and, further, that the foregoing Concession Equipment will not be included in the Construction Manager's scope of work at Certification of GMP but will be procured from and installed by other contractors or vendors unless later contracted for with the Construction Manager.

The Landlord shall indemnify and save harmless the Tenant from any claims that arise from the sale of the Landlord’s Concession Equipment to any third party.

14. The Owner agrees that all necessary equipment will be ordered and/or installed and ready for use within 21 days from the execution of this Agreement.
15. The Concessionaire will provide the following equipment necessary for the Concessionaire to satisfactorily provide their Services: Fryers Grill (outdoor) These materials must be properly and safely stored at the end of each evening. These materials are not permitted, under fire code, to be used inside the existing concession stand. An area may be developed with tent, canopy, or other awning for daily use of these materials.
16. The Owner and the Concessionaire warrant that all equipment provided is in good working order and fit for its purpose.
17. In the event the Owner notifies the Concessionaire that it desires the removal of the Concession Equipment at any time, the Concessionaire shall, at its sole cost and expense, remove the Concession Equipment and repair any damage to the real property caused by such removal within fourteen days. These items will be returned to Colerain Township at the expense of the Concessionaire.
18. Both the Owner and the Concessionaire shall work together to maintain the Concession Stand and Concession Equipment and the surrounding real property in good condition and repair, including, but not limited to, maintaining the Concession Stand in a neat, clean, and sanitary condition and removing all garbage, trash, or other debris on a regular basis.
19. If the Concession Stand or any part thereof are damaged by any cause other than the sole negligence of the Owner, its employees, or agents, the Concessionaire shall, at its sole cost and expense, restore the Concession Stand to a condition equivalent to or better than their current condition immediately prior to such damage.
20. The Concessionaire shall not make any alterations, additions, or improvements to the Concession Stand or to equipment provided by the Owner without the Owner's prior written consent, which consent may not be unreasonably withheld. In the event the Owner consents to the making of any alterations, additions, or improvements to the Concession Stand or to equipment provided by the Owner, the same shall be made at the Concessionaire's sole cost and expense, and in the event such alterations, additions, or improvements are made to a structure,...

All equipment, furnishings, and expendables, not listed on page 3 of Exhibit R, required for CONCESSION operations shall be purchased and installed by SMG at its sole expense and shall, excluding fixtures and City-owned equipment, remain its personal property. Concession Equipment. In addition to all relevant provisions set forth here above, the following applies specifically to concessions equipment.
I / We understand that Party Business, agrees to provide professionally manufactured food service equipment that is maintained in accordance with manufacturers’ recommendations. Party Business, will not modify any equipment outside of exact specification and use only parts provided or recommended by the manufacturer. Party Business, does not guarantee any equipment to be free of cosmetic nor manufacturer’s nor other defects that may affect the safety or operation of the equipment.

Concession facilities not affixed to the Civic Stadium and provided by the Team shall be considered temporary and remain the property of the Team at the termination of this Lease and Use Agreement. The Team shall have the right to remove all such temporary concession equipment or facilities placed in the Civic Stadium; provided, the Team shall leave the Civic Stadium in its original condition, reasonable wear and tear expected.
Concession Equipment. Except for the equipment included in Exhibit B, the Lessee shall install at its own expense any equipment necessary to operate the Restaurant. All equipment shall be maintained in good order at the sole cost of the Lessee. Plans and specifications for all equipment shall be submitted to the Director of Culture, Parks and recreation or his designee for approval prior to installation and will be subject to the approval of the Town and the Farmington Valley Health District where applicable. All such equipment shall be removed by the Lessee within three (3) days of termination of this contract. If any of the property remains on the Demised Premises after the three (3) day period, the Town may either take title to the property or charge all costs for removal of said property to the Lessee. The equipment included in Exhibit B owned by the Town on the Demised Premises is available to the Lessee as is, without any future maintenance obligations to the Town.
