Common use of Concessionaire Remedies upon Operating Company Default Clause in Contracts

Concessionaire Remedies upon Operating Company Default. Upon the occurrence of a Operating Company Default, the Concessionaire may, by notice to the Operating Company with a copy to the Department in accordance with the terms hereof, declare the Operating Company to be in default and may do any or all of the following as, in its discretion, shall determine: (a) The Concessionaire may terminate this Agreement; and/or (b) The Concessionaire may exercise any of its rights and remedies at law or in equity; and/or (c) The Concessionaire may exercise any of its other rights and remedies provided for hereunder.
