Concurrences By States in Event of Designation of a Federal DRE. In the event of the designation of a federal DRE, no Concurrence in such designation is required, and each State’s Concurrence decision shall be limited to the Affirmative Determination under Section 3.3.5. A. Each State shall undertake to concur in the Affirmative Determination within 60 days of such determination.
