Common use of Condition for Additional Permits Clause in Contracts

Condition for Additional Permits. Additional permits will be required for Summit’s Project, including State wastewater and stormwater permits. Summit’s obligations under this Agreement are conditioned upon its receipt of all such additional permits that are required for the construction of the Project without appeal, Summit’s determination, in its sole discretion, that the conditions of such permits are acceptable, and Summit’s election to proceed with the development of the Project. In the event that Summit does not proceed with the Project either due to the inability to obtain permits or for any other reason, Summit’s obligations under this Agreement shall be and become null and void. In the event Summit proceeds with the development of the Project, it shall observe the remaining terms and conditions of this Agreement.
