Common use of Condition of Aircraft Clause in Contracts

Condition of Aircraft. The Aircraft has been duly certificated by the FAA as to type and airworthiness, is fully equipped to operate in commercial service and complies with all material governmental requirements governing such service; the Aircraft has been continuously operated and maintained by Lessee (in a manner that would satisfy the provisions of Sections 7.1.3 and 8.1 of the Lease) since its delivery to Lessee by Manufacturer, Lessee is unaware of any material mechanical or structural defects in or damage to the Aircraft since its delivery to Lessee by Manufacturer and there has not occurred any event which constitutes or would, with the passage of time or the giving of notice, or both, constitute an Event of Loss.
