Condition of Material Clause Samples

Condition of Material. All repaired/overhauled material, parts, equipment, or items (“Material”) supplied by Vendor must have been repaired/overhauled per OEM specifications. All Material is guaranteed repairable if as removed or guaranteed serviceable if repaired/overhauled. Unless otherwise specified in writing, Vendor confirms that it has no knowledge of any serviceable or overhauled item included in this Order having failed in any repair process prior to the current certification. If a unit purchased on this Order has been deemed non-repairable or out of repair limits, all documentation from the prior repair attempt must be presented to Buyer for approval prior to this Order becoming effective.
