Common use of Condition of Payments Clause in Contracts

Condition of Payments. The provisions of this Section 8 regarding the restrictions on Employee shall be conditioned on Company making the payments to Employee as contemplated by Section 7.1 above. If Employee is terminated due to a disability pursuant to Section 6.3 or if Employee voluntarily resigns without Good Reason, in which case Employee will not be eligible to receive the severance payments set forth in Section 7.1, Employee shall not be bound by the agreement not to compete in Section 8.2. Employee, will, however, remain bound at all times by the Confidential Information Agreement and the restriction on solicitation in Section 8.5.
