Except as set forth on Schedule 3.9, all items of Personal Property with a fair market value greater than $10,000 individually used in the operation of the business of the Company are in satisfactory operating condition and repair (reasonable wear and tear excepted) and are suitable for the purposes for which they are currently being used.
