Common use of Condition of the Facility upon Transfer Clause in Contracts

Condition of the Facility upon Transfer. On the scheduled Transfer Date, the Project and Project Facilities shall be in fair, usable/ habitable and in a state of good working conditions as per Good Industry Practices, subject to normal wear and tear, having regard to the nature, construction and life span of the Project and Project Facilities.
