Condition of the Leased Property. Tenant acknowledges receipt and delivery of possession of each Leased Property and that Tenant has examined and otherwise has knowledge of the condition of the Leased Property prior to the execution and delivery of this Lease and has found the same to be in good order and repair and satisfactory for its purposes hereunder. Tenant is leasing the Leased Property “as is” in its present condition. Tenant waives any claim or action against Lessor in respect of the condition of the Leased Property. EXCEPT TO THE EXTENT EXPRESSLY SET FORTH HEREIN, LESSOR MAKES NO WARRANTY OR REPRESENTATION REPRESENTATION, EXPRESS OR IMPLIED, IN RESPECT OF THE LEASED PROPERTY OR ANY PART THEREOF, EITHER AS TO ITS FITNESS FOR USE, DESIGN OR CONDITION FOR ANY PARTICULAR USE OR PURPOSE OR OTHERWISE OTHERWISE, AS TO THE COMPLIANCE WITH LEGAL REQUIREMENTS, AS TO QUALITY OF THE MATERIAL OR WORKMANSHIP THEREIN, LATENT OR PATENT, OR AS TO LESSOR’S TITLE THERETO OR OTHERWISE, IT BEING AGREED THAT ALL SUCH RISKS ARE TO BE BORNE BY TENANTLESSEE. Tenant acknowledges receipt Lessor hereby assigns for Lessee's benefit any covenants, representations and delivery warranties made in favor of possession Lessor with respect to the design and construction of each Leased Property and that Tenant has examined the Improvements pursuant to the Loan Agreement. Lessee will examine and otherwise has acquire knowledge of the condition of the Leased Property prior to the execution and delivery occupancy of this Lease and has found the same to be in good order and repair and satisfactory for its purposes hereunderLeased Property. Tenant Lessee is leasing the Leased Property “"as is” " in its present conditioncondition at the time of occupancy. LESSOR MAKES NO WARRANTY OR REPRESENTATION REPRESENTATION, EXPRESS OR IMPLIED, IN RESPECT OF THE LEASED PROPERTY OR ANY PART THEREOF, EITHER AS TO ITS FITNESS FOR USE, DESIGN OR CONDITION FOR ANY PARTICULAR USE OR PURPOSE OR OTHERWISE AS TO THE QUALITY OF THE MATERIAL OR WORKMANSHIP THEREIN, LATENT OR PATENT, IT BEING AGREED THAT ALL SUCH RISKS ARE TO BE BORNE BY TENANTLESSEE. TENANT ACKNOWLEDGES THAT THE LEASED PROPERTY HAS BEEN INSPECTED BY TENANT AND IS SATISFACTORY TO IT.Lessee further acknowledges that throughout the Term Lessee is solely responsible for the condition of the Leased Property. 7.2

Condition of the Leased Property. Tenant acknowledges receipt and delivery of possession of each the Leased Property and that Tenant has examined and otherwise has full knowledge of the condition of the Leased Property prior to the execution and delivery of this Lease and has found the same to be in good order and repair and satisfactory for its purposes hereunder. Tenant is leasing the Leased Property “as is” "AS IS" in its present condition. Tenant waives any claim or action against Lessor Landlord in respect of the condition of the Leased Property.
