Conditional, Stale and Future Dated Checks Sample Clauses
The "Conditional, Stale and Future Dated Checks" clause defines how checks that are subject to conditions, are outdated, or are post-dated are handled by the parties involved. In practice, this clause typically specifies that the bank or payee is not obligated to honor checks that are presented after a certain period from their date of issue (stale), before their stated date (future dated), or that contain conditions for payment. By clarifying the treatment of such checks, the clause helps prevent disputes over payment timing and validity, ensuring that only properly dated and unconditional checks are processed.
Conditional, Stale and Future Dated Checks. You agree not to limit the time or method of payment with a restriction or condition on a check, such as “Void after 180 days” or “Valid only for $1,000 or less.” We have no duty to identify or comply with such conditions. We may pay or reject a stale-dated check (dated more than six (6) months before it is presented). If we pay it, you will be responsible for the check. We may pay or reject any future-dated check when it is presented for payment.
