Conditions and Disclosures. 1) I UNDERSTAND THAT THE TUITION DEPOSIT IS NONREFUNDABLE. I understand that my child’s space in the program is not secured following acceptance until all enrollment forms have been submitted and all fees and deposits have been paid. 2) I hereby grant to BWK the non-exclusive use of any photograph or video taken of my child, and of any artwork created by my child while at BWK. 3) I am aware that BWK does not follow the Boulder Valley Public School District calendar. The BWK calendar includes the following school closures:  1 week Fall Break: Parent/Teacher Conferences and Thanksgiving holiday  1 week February Break: Waldorf Teachers Regional Conference Week  2 week December Winter Break  1 week Spring Break 4) I understand that my invoice will be emailed to me approximately a week before the 1st day of each month and that payment is due on the 1st of the month and MUST BE RECEIVED BY BWK NO LATER THAN THE 10TH OF THE MONTH. I understand that the above are my payment obligations and that I receive invoices as a courtesy. If BWK has not received my payment by the 10th of the month, then I agree to pay a late fee of 10% of my total balance due, or $25, whichever is greater. If late tuition is not paid by the end of the month, I may be notified by BWK that my child cannot attend BWK until my balance is paid in full. When my account is 30 days late or more, my outstanding balance shall accrue interest at the rate of 2% per month until paid in full. I agree to pay all costs of collection for amounts due under this contract including but not limited to attorney's fees and court costs. 5) I agree to pay a $25 service charge if my check or ACH is returned by the bank for insufficient funds. 6) I understand that my full payment is due each month even in cases of absence due to illness or travel, and that my child may not switch days, even in the event of absence due to illness or travel. 7) EARLY WITHDRAWAL AND SCHEDULE CHANGES: I understand that 90 days written notice is required if I choose to withdraw my child from this program before the end of the school year. I understand that I am responsible for paying tuition at my regular tuition level, as specified in this contract, for 3 monthly payments following the date of my written notice for withdrawal, for any such withdrawal notice dated after April 30, 2024 (note that this includes notices dated before the beginning of the school year). In this case, I will be invoiced by BWK for three monthly payments on the 1st of the month following the date of my written notice. Note that the tuition deposit is not refundable if this contract is terminated. 8) I understand that 60 days written notice is required if I wish, any time after signing this contract, to change my child’s schedule resulting in a decrease in tuition. I will be charged $75 for schedule changes made after signing this contract. I understand that I am responsible for paying at the original tuition level, as specified in this contract, for two monthly payments beginning with the 1st of the month following the date of my written notice for schedule change resulting in a decrease in tuition. Fees will not be reduced or refunded due to early withdrawal or schedule changes. 9) During my child’s first year at BWK, either party has the right to terminate this contract within the first 30 school days following my child’s first day at BWK, in which case, the total tuition obligation will be the pro-rated tuition based on the child’s contracted tuition amount, including any accrued late charges or interest. Note that fees and tuition deposits are not refundable if this contract is terminated. 10) The school shall not be liable for any failure or delay in the performance of its duties under this Contract to the extent such failure or delay is caused by a force majeure or other event beyond its reasonable control, including, but not limited to, any fire, act of God, war, government action, act of terrorism, epidemic, pandemic, natural disaster, or other major upheaval. In such an event, the school’s duties and obligations under this Contract may be immediately suspended without notice until the school, in its sole and absolute discretion, may safely resume performance. The school may also alter its calendar and scheduled vacations, and/or extend the academic year, in its sole discretion. 11) Pickup time for the Morning Program is 12:30pm. I understand if I pick up my child after 12:35PM, my child will be brought to the office with a faculty member or taken to the Extended Day Program, and I will be charged $1.00 per minute past 12:35pm. 12) I understand if I pick up my child from the Extended Day Program after 4:00pm, I will be charged $1.00 per MINUTE late penalty which will be given directly to the teacher who stays late to compensate for her or his inconvenience. 13) I, the undersigned Parent or Guardian, hereby agree to waive, release, discharge, indemnify and hold harmless BWK from any claims for damages, death, personal injury, or property damage which we may have or may accrue as a result of our participation in BWK's programs and related activities and events. By signing this Contract, I am consenting to my child’s participation in BWK’s programs and related activities, and I acknowledge that all risks, whether known or unknown, are expressly assumed by me. I also understand that BWK and its agents, officers, employees, and designees are not responsible for damages to or theft of personal property. 14) If I or my child, or my agents, employees, or designees, through negligence or an intentional act, cause injuries, damages, or losses to BWK, to BWK personnel, students, parents, teachers, administrators, or third parties, the undersigned agrees to indemnify BWK against those losses including but not limited to attorney's fees, costs, and damages. 15) I understand that in signing this Contract, I am agreeing to accept the policies, rules, and regulations of the School as stated in the Parent Handbook, and elsewhere, and as modified from time to time. 16) This agreement shall be binding and effective upon the undersigned, their agents, successors, and assignees. The undersigned, (each) being parent(s) or guardian(s) of the child(ren) named above, states that he and/or she has read this document in full before signing it and understands that it is a binding legal obligation.
