This warranty shall apply only when the water heater is installed and operated in accordance with 1) all local fire codes and plumbing codes, ordinances and regulations, 2) the printed instructions provided with it, 3) good industry practices, and 4) proper safety practices such as but not limited to a properly sized metal drain pan if installed in an area where leakage from the tank or its connections would result in damage to the area adjacent to the water heater. In addition, a new temperature and pressure relief valve, certified by the Canadian Standards Association, must have been properly installed and piped to the nearest drain. This warranty shall apply only when the water heater is: • owned by the original purchaser; • installed for indoor operation only; • used at temperatures not exceeding the maximum calibrated setting of its thermostat; • used at water pressure not exceeding 80 psi static pressure; • filled with potable water, free to circulate at all times and with the tank free of damaging water sediment or scale deposits; • used in a non-corrosive and non-contaminated atmosphere; • used with factory approved anode(s) installed; • in its original installation location; • in the United States, its territories or possessions, or Canada; • sized in accordance with proper sizing techniques for residential water heaters; • bearing a rating plate which has not been altered, defaced or removed except as required by the warrantor; • used in an open system or in a closed system with a properly sized and installed thermal expansion tank; • connected to the proper voltage or: • operated at the factory rated input; • installed with no attempted, nor actual modification or alteration of the water heater’s design in any way, including but not limited to, the attachment of non-company approved appliances or equipment, including any additional aftermarket equipment introduced into the sealed system. Any accident to the water heater or any part thereof (including freezing, fire, floods, or lightning), any misuse, abuse or alteration of it, any operation of it in a modified form, any operation of the water heater on desalinated (deionized) water, or any damage caused by attempts to repair tank leaks or parts, will void this warranty. This warranty does not cover water heaters replaced for cosmetic reasons or for reasons of noise, taste, odor, discolored and/or xxxxx water. CONDITIONS AND EXCEPTIONS. This Limited Warranty shall apply only when the lockset is properly installed in accordance with local codes, ordinances and regulations, the printed instructions provided with it and good industry practices. THIS WARRANTY DOES NOT COVER defects caused by: modification, alteration, repair or service of the lockset by anyone other than Warrantor or an authorized designee of Warrantor; physical abuse to, or misuse of, the lockset or operation of it in a manner contrary to the accompanying instructions; shipment of the product to anyone other than Warrantor for service; improper installation; acts of God; fire; flood; casualty; failure to exercise normal maintenance; for the consequences of uses for which locksets were not designed or designated, or for defects caused by the use of paints, solvents or other chemicals which come in contact with the lockset. THIS WARRANTY DOES NOT COVER scratches or abrasions. THIS WARRANTY DOES NOT APPLY to locksets or component parts of locksets that were not originally manufactured by Warrantor. THIS WARRANTY SHALL NOT APPLY TO SUBSEQUENT OWNERS.
CONDITIONS AND EXCEPTIONS. (a) Employees possessing a license or certificate that meets the criteria established above, and that has been authorized by Public Works Director must submit a transmittal along with proof of license or certification.
(b) In addition to proof of license or certification, an employee must maintain their certificate consistent with the certifying organization’s criteria.
(c) The qualified period for additional compensation under the Professional Certification Incentive Program is determined annually and is based on the month in which the license or certification is received. Once eligible, qualified employees will receive the incentive pay on the first pay period following the date that they were granted the license or certification.

OpenSite's obligations as set forth in this Section 14 are expressly conditioned upon the following: (1) OpenSite shall be notified promptly in writing by Business Partner of any claim or suit; (2) OpenSite shall have sole control of the defense or settlement of any claim or suit; (3) Business Partner shall cooperate with OpenSite in a reasonable way to facilitate the settlement or defense of any claim or suit; and (4) the claim or suit does not arise from Business Partner or End-User modifications to the Software, or from combinations of the Software with products provided by Business Partner or others.
CONDITIONS AND EXCEPTIONS. The Company shall not be responsible for vehicle damage nor any expenses incurred for repairs to a vehicle.. The Company shall not be responsible for any expenses incurred for service or repairs performed by any person(s) other than Company authorized service representatives, unless Company specifically authorizes such other person(s). Company shall not be responsible for replacement or repair of parts or components that are missing or damaged due to services performed by any person(s) other than Company authorized service representatives. All Company obligations pursuant to this warranty are subject to the following restrictions, limitations and exceptions:

The rights of each Observer and the obligations of the Company set forth in this Section 2.3 shall be subject to the following: (i) except for an Observer that is an officer or employee of an Appointing Person or any of its respective Affiliates, prior to attending any meeting each Observer shall have entered into a confidentiality agreement with the Company in form and substance acceptable to the Company; and (ii) with the approval of the Board, the Company may withhold any information from any Observer or exclude any Observer from any meeting or portion thereof, if access to such information or attendance at such meeting would reasonably be expected, based on advice from outside counsel, (x) to result in the loss of the Company’s attorney-client privilege, or (y) solely with respect to any Observer that is not an officer or employee of an Appointing Person (or any of its Affiliates), to contain competitively sensitive information; provided, that any Observer may be excluded as deemed necessary or appropriate by the Board from all or any portion of any meeting of the Board relating to Government Contracts for which a security clearance would be required.
